While this event was taking place, restaurant staff intervened. Staff asked the man to sit somewhere. But Copenhaver responded by attacking one of them. Employees said that Copenhaver looked quite drunk and was not wearing any shoes at the time.

News sources trying to gather information about the incident stated that Copenhaver was accused of simple battery and disorderly behavior. It was unclear whether the man had a lawyer who would enable him to answer the charges. He was released after he had already paid the $650 bail.
